Legal Dr. Gustavo López-Muñoz y Larraz has been interviewed last February 21, in his capacity as a recognized international expert in extraditions, by the Chinese news network CGTN in relation to the gigantic joint Spanish-Chinese police action dubbed “Operation Wall“.
This is the dismantling of a network of massive telephone fraud perpetrated from villas mainly located in Madrid, Barcelona and Alicante and targeting citizens of the People’s Republic of China and has resulted in the arrest of 269 Chinese citizens of which the vast majority had Taiwanese citizenship.
According to the Extradition Treaty signed between Spain and the People’s Republic of China, this Government has requested to Spain the extradition of all the detainees to China but the Government of Taiwan, with which Spain does not maintain formal diplomatic relations due to the imposed concept of “One China”, has lodged a protest with the Spanish Government arguing that the Taiwanese citizens, in their case, should be extradited to Taiwan, but never to Communist China because they would certainly not get a fair trial in view of China’s constant violations of Human Rights.
On Friday, February 17, the Council of Ministers of the Spanish Government agreed to authorize the start of the judicial phase of the extradition process, which has forced the Audiencia Nacional to reinforce its operational capacities very especially in view of the avalanche of cases that this represents, including not only a greater number of Judges and officials, but also of Prosecutors and Defense Lawyers.
